Part 137 Mandatory Fee Dispute Program

Two years ago, the Administrative Board of the Courts issued an order establishing a a mandatory fee dispute resolution program. The rules apply to all matters begun on or after JANUARY 1, 2002, and require that all attorneys representing clients in civil matters submit fee disputes to arbitration. With some exceptions, the rules apply to disputed amounts between $1,000.00 and $50,000.00

Arbitration is mandatory whenever an attorney and their client cannot agree on the fee, or whenever the client requests arbitration. The arbitration award is final and binding unless de novo review is sought under the rule.

New York County Lawyers' Association in partnership with Bronx County Bar Association and the Association of the Bar of the City of New York has run the Joint Fee Dispute Program, a voluntary program .

We currently need volunteers to serve as mediators and arbitrators. Attorneys who have been admitted to the bar for at least five (5) years are encouraged to apply. Please send a resume and cover letter highlighting any relevant experience in alternative dispute resolution to:
